Court Rules Unanimously: Illinois School Must Allow "Be Happy, Not Gay" T-shirt

We read:
" The U.S. Court of Appeals for the 7th Circuit reversed a lower court's ruling against an Illinois student Wednesday, saying the district court must order a Naperville high school to suspend its ban on a T-shirt that reads "Be Happy, Not Gay" while the student's lawsuit proceeds. School officials prohibited student Alex Nuxoll, who is represented by Alliance Defense Fund attorneys, from wearing the clothing.

"Christian students shouldn't be discriminated against for expressing their beliefs," said ADF Senior Counsel Nate Kellum. "Public school officials cannot censor a message expressing one viewpoint on homosexual behavior and then at the same time allow messages that express another viewpoint. The court's ruling is a victory for all students seeking to protect their First Amendment rights on a school campus."

Nuxoll, a student at Neuqua Valley High School, desires to express his perspective at various times throughout the year, including the next school day after the "Day of Silence." Other students at the school are permitted to wear shirts with messages supporting homosexual behavior as part of the "Day of Silence," which is sponsored by the Gay, Lesbian, Straight Education Network. The 7th Circuit ruling prevents school officials from singling out Nuxoll's message for censorship.

Our courts have chosen to interpret the establishment clause in our First Amendment in a manner that serves to purge any mention of religion or gesture of faith from the public discourse. In our headlong rush to embrace multi-culturalism, moral relativism and establish non-judgementalism as the de facto religion of the U.S. of A, we have created several generations of young people who have no beliefs other than the vague, amorpophous sense that all cultures are equal and no one system of social & societal mores is superior to another. We are the only culture in the history of the world that has gone down the road of societal and cultural self immolation. I fear that our civilization is not long for this world. When we are confronted by fanatic, radical believers in the religion of peace, whose aim is the destruction of the West, we will not have the strength to defeat them.

"be happy not gay" is intended to be directly anti-gay and thus "hateful" in intent - so it's pot/kettle to accuse gays of being hateful. This very site seems to delight in very and hateful anti-gay sentiment; it's like an obsession (maybe freudian reasons?!).

Being against something is the same as hating it? Being against something is the same as being hateful?

Quite frankly, you begin to lose any sort of credibility when you espouse such ridiculous sentiments.

"I don't like chocolate ice cream."

Hatefull or not, it is free speech. And it if opens a pandora's box of kids wearing whatever crazy t-shirts they want with absolutely no standards, so be it.

I do find the t-shirt "be happy, not gay" offensive. It implies that gays aren't happy, and that you can't be happy if you're gay. It's a statement of heterosexual superiority, a sort of straights uber alles. Might as well wear a t-shirt wtih a penis penetrating a vagina and the words, "If you're not like me, fuck you."

It's just as offensive as wearing a t-shirt that says "Women not getting laid with you? Try men."

But whatever, life is full of offensive things, the kids might as well learn to live with them.

Gitar - there's a slight difference in the general use of the words 'hate' and 'hateful', where the latter can mean just nasty or intended to be hurtful, rather than an expression of pure hate.

Actually, there is a great deal of difference between 'Be Happy, Not Gay' and 'Gas Jews'. The first is expressing a viewpoint, the second is advocating violence. The two are not similar statements at all, and the one that advocates violence directly can be banned. The same theory that applies to yelling fire in a crowded theater or inciting a riot.

This is getting out of hand, I was surfing online. I just found this site, reading ever single comment, I can say one thing, amusing as this is, gays sure love being dramatic.

Us straight people have the right to be pissed.

I noticed that homosexuals like to twist words to their own ends. Making themselves the victims, demonizing those who are not homosexuals. what you do in your bedroom is none of my business, I don't want to know nor care what goes on. Don't flaunt your rear ends, don't wag your genitals in public, you're individuals not animals. there is a reason why we're given reasoning, act like individuals.

whatever the consequences comes your way, is of your own actions, is not my doing, I can't control the universe. read before you judge someone.

It's not uncommon for gay aka homosexual to be judgmental toward others, like other individuals.

There are too many variations for any of us to judge. You can be homicidal and mellow on the next. You can be a jackass and not care if a bullet hit you. You can be hit by a passing vehicle and not care if your partner is dead. every one of us has two sides of the coin.

Rather than acting like sissies and overzealous hippies, simmer down and grow up. geez, you can't expect for the world to cater to your every whim. You think the world is not fair, so what, news flash, the world is never fair, hey we bleed, we die thats the matter of facts. We come across angry ghost or two, when murphy's law is in full swing.

quit acting like saps and simmer down, may be we can shove off in our separate ways. Doing what we enjoy. I don't advocate nasty comments or mockery of others or anyone, if you gays quit acting like holier than thou routine, then things would be mellow. You do your thing, I do mine, I like doing my own thing without the care of the world.

I can choose to be religious or nonreligious, no one can make me or force which ever thing that comes my way. Life is too short in being an ass. again "READ BEFORE YOU JUDGE!!!!!"

Not every one of us are your enemies, some of us straights abhor violence. enough is enough, no more of the so-called hate speech nonsense.

If you can't resort from name calling, fine, act like an oversensitive and inconsiderate jerks, hope whichever materialistic god or some other weird thing you serve, would pass judgment on you.

Don't be disingenuous - of course the t-shirt slogans were intended as anti-gay (anti-homosexual and/or anti-activist gay).
And btw there are a lot of words in the English language which can have several meanings depending on context - it's called a 'homonym' - ironically enough - lol!
